Thinking about bankruptcy?

Filing for bankruptcy is a difficult decision, but not one you should feel ashamed of. Well over a million Americans will file for bankruptcy this year for a number of different reasons.

What should you expect from the process and what are the steps to take?

Determine your options

The debt is mounting. You've been trying to hold it together for months, if not years. It just doesn't seem like you'll ever be able to get back to square one.

It's difficult to see your options when you're struggling every day just to get by. Consider speaking with a trained and certified debt and budget counselor to evaluate the services available to you. They'll review your finances and give you an honest review of your options, which may include bankruptcy.

Find an attorney

You don't have to use an attorney to file for bankruptcy, but it can be a very complex legal process and having an expert on your side will make filing much easier for you and your family.

Receive pre-filing bankruptcy counseling

In order to progress with your bankruptcy filing the law requires you receive pre-filing bankruptcy counseling. This counseling includes a complete review of your income, expenses, assets and liabilities. Working with your counselor you will create a manageable spending plan, as well as short-term and long-term financial goals.

At the conclusion of your counseling session, you will be given a certificate of completion, which is necessary to continue with your bankruptcy filing.

Receive pre-discharge education

Before your debts can be legally discharged, you must complete a pre-discharge education course. This course is designed to ensure that you have the financial tools necessary to successfully manage your money going forward.

After you've completed your education course, you'll be given a certificate, which is required in order to have your debts discharged.

Discharge of debts

Once you've completed and filed all of the required paperwork, you will be required to appear in court. If everything is in order, you will be declared bankrupt by the judge and your applicable debts will be discharged.
